Q: Company Changes and Amendments
A: In South Africa, making changes and amendments to a company is governed by the Companies Act of 2008. These changes can include updates to the company’s name, registered address, directors, and Memorandum of Incorporation (MOI).
Q: What is a Tax Debt?
A: A “tax debt” is an amount of tax “due and payable” to SARS.
Q: What causes a Tax Debt?
A: Tax debts can arise from administrative penalties on late or non-submission of tax returns, failure to submit tax returns, the submission of returns without payment, partial payment of tax liability or from SARS audit.
Q: How should Tax Debt be handled?
A: Taxpayers agreement and ability to settle this debt will determine the details of each taxpayer’s response Options for fixing tax debt include
1.SARS payment or installment plans: Request a payment plan with SARS
2.Offer in compromise: Settle your debt for less than you owe.3.Currently not collectible: Negotiate agreement to defer/delay tax debt collectionwhen unable to pay.
4.Remission: Apply for relief from penalties.
5.Bankruptcy: Consider this option.6.Amend your return: Correct mistakes to lower the amount you owe
Q: What is an importer?
A: Any person (local or foreign) who imports goods into South Africa. Any importer (e.g. individual or juristic person) who wishes to import goods into South Africa must register as an importer
Q: What is an exporter?
A: Any person (local or foreign) who exports goods out from South Africa. Any exporter (e.g. individual or juristic person) who wishes to export goods out from South Africa must register as an exporter
Q: What is a SADC Certificate?
A: Certificate is issued by an authority attesting that goods conform to specific Rules of Origin as per the criteria provided in the SADC Protocol on Trade. E.g. It is required for goods obtained, manufactured, produced, or processed in Tanzania and exported to the Southern Africa Development Community (SADC).
